During course of cross-examination it came on??surface that the plaintiffs of instant suit have filed FC Suit No 137/2020 in this Court wherein they have stated in para No 4 of plaint that an area of 12 acres land out of survey number of instant suit gifted to defendant No 3 Muhammad Akram (defendant NO 1 in present suit) by their grandfather Muhammad Haneef which is also admitted by the rest of plaintiffs in their we/s filed in such suit which has been disposed of vide Judgment and Decree dt:07.10.2021, but now the plaintiffs and some of defendant of FC Suit No 137/2020 filed instant suit for cancellation of gift in respect of such 12 acres which is not maintainable U/O II Rule 2 CPC and under Article 114 of Qanun-e-Shahadat. Learned counsel for plaintiff is put on notice to satisfy the Court. Heard. Order passed and announced in open Court. Suit of the plaintiff is hereby rejected U/O 7 rule 11 CPC.
