2. Today, the matter was fixed for compliance of the absolute order passed by this Court on 01-07-2026. In compliance thereof, Mr. Ghulam Hussain, Assistant Complaint Officer, BISP Daur, appeared before the Court and submitted an application duly supported by his affidavit, wherein he stated that the nuisance, which was the subject matter of these proceedings, has been removed and the BISP Daur Office has been shifted to another suitable place. The Assistant Commissioner, Daur, has also submitted his compliance report, confirming that the nuisance has been removed and the office has been shifted from the disputed premises to another place. Furthermore, the complainant also appeared and filed an application stating that the opponent has removed the nuisance in compliance with the order of this Court and that he has no objection if the instant proceedings are disposed of. The statements made in the affidavit of the Assistant Complaint Officer, the compliance report submitted by the Assistant Commissioner, Daur, and the application filed by the complainant are consistent and corroborate each other. It is, therefore, evident that the absolute order dated 01-07-2026 has been complied with in its true letter and spirit. Since the object of the proceedings has been achieved and the complainant himself has expressed no objection to the disposal of the case, no further proceedings are called for. Accordingly, the instant proceedings under Section 133 Cr.P.C. are hereby disposed of as having been fully complied with. The applications, affidavit, and compliance report shall form part of the record. File be consigned to the Record Room after completion of all codal formalities. |
