Criminal Misc: application U/S 491-A Cr.P.C called. Applicant is called absent. Mr. Zaheeruddin Nohri learned advocate for applicant is present. Mr. Hemoon Kolhi learned ADPP for state is present. Opponent No.1 is present. Mr. Javaid Akthar learned advocate is present and he has filed his vakalatanama on behalf of opponent No.1. In compliance of Rule Nisi issued by this court the alleged detenue Mst. Farhana produced by ASI Dayal Das of P.S Chachro with the help of LHC Sughran/Buckle No.685. He has also submitted the report of SHO, P.S Chachro along with Mashirnama of recovery of alleged detenue. Statement of alleged detenue namely detenue Mst. Farhana is recorded. In view of the statement of alleged detenue Mst. Farhana, she is set at liberty. She is allowed to go with respondent No.1 Lakhadino (who is her father) as per her choice. So far the matter of custody of her three minor children is concerned, who are stated to be residing in the house of applicant, she can approach the proper Guardians & Wards Court having jurisdiction. The ASI and LHC present in court are directed to leave the alleged detenue at her destination safely and submit such compliance report before this court.
