Attendance of accused Nazeer already stands dispensed with due to his medical condition. Learned State Counsel Mr. Nadeem Ahmed Tunio is present. Learned counsel for the accused persons is present. The complainant is also present. The work of the Court is suspended due to the call of the District Bar Association, Larkana. Absence of accused Adeel is excused in the interest of justice. At the very outset, when the parties and their learned counsels appeared before the Court, Mr. Samad Mangi, learned counsel for the accused persons, in a sudden and rash manner, directly addressed the clerk of the Court by saying: ???Why are you indicating at the complainant???? (tun hun khe ishara cho tho karein). Observing this conduct, I, as Presiding Officer, asked the learned counsel to address any grievance directly to the Court, as this is the proper decorum. However, instead of correcting his approach, the learned advocate insisted upon his stance and questioned why he should address the Court directly. He was informed that such behaviour is inappropriate, discourteous, and carries a tone of threat. Yet the learned advocate remained adamant and persisted with the same conduct. At last, it was told to him that if he was not satisfied, he was at liberty to seek transfer of the case before any other Court as per his convenience. Upon this, he left the Court in an angry manner. Thereafter, the complainant was asked whether any such indication had been made towards her by the clerk. She categorically denied the allegation. After this incident, several learned advocates present in Court, including Mr. Muhammad Shareef Ghanghro, Mr. Qadeer Domki, Mr. Abdul Ghani Junejo, and the learned DDPP, came forward to the rostrum. They expressed regret on behalf of the learned advocate and requested that the matter be forgiven for the smooth functioning of the Court. Their gesture of humility and respect was appreciated. It is mentioned in the Holy Qur???an: ??????and those who restrain anger and who pardon people; for Allah loves the doers of good.??? (Surah Aal-Imran, 3:134) Throughout the incident, the Court exercised patience and maintained complete judicial restraint. As continuing the matter further would bring no meaningful result and may disturb the working environment, the issue was allowed to settle. When I was later sitting in chambers, two of the accused persons appeared and also apologized. They were informed gently that they remain at liberty to seek transfer of their case, should they wish to do so, as this is their lawful right. It is further noted that the learned advocate, being an officer of the Court, is respected for his role and experience. Misunderstandings sometimes arise in the heat of proceedings, and a moment of haste should not overshadow the years of service and professional commitment of any advocate. If he had any reservation, he could have addressed it privately with the Court or could have moved a transfer application, which is the dignified course. Respect for the Court is not for the personal benefit of a judge; rather, it enhances the stature of the advocate himself. As the Holy Qur???an reminds: ???O you who believe, do not let hatred of a people cause you to avoid justice. Be just; that is nearer to righteousness.??? (Surah Al-Ma???idah, 5:8) Judges are not infallible. They are human beings, capable of error, just like any other person. The mutual respect maintains the dignity of the institution of justice. The matter is thus recorded in the case diary with the hope that may Allah the Almighty guide all of us to the right path. Put off to 13-12-2025 for evidence. Issue process to the remaining PWs.
