Matter called. Learned counsel for the plaintiff appeared. Plaintiff and witnesses appeared. Learned counsel for the defendant remained absent, his learned Associate appeared. As such, matter was kept aside several times during course of the day. Learned counsel for the defendant appeared belatedly in late hours, marked attendance and went away without waiting call of the court, without moving any adjournment application or intimation requesting therein either to fix the matter or to adjourn it to some future date. Thereafter, matter was called repeatedly till 03:00 P.M but at this time no witness available from the plaintiff side including the plaintiff and in this regard learned counsel for plaintiff sent adjournment application on the ground of not feeling well of plaintiff and witnesses bearing no objection from the defendant side. As such, the said application appears to be collusive from both sides. As the plaintiff and his witnesses left the court without permission and without waiting next call of the court. As such, cost of Rs.500/- imposed upon the plaintiff to be deposited by him in district Court Dispensary till next date, failing which any appropriate order shall be passed. AS regarding the conduct of defendant side, the cost of Rs.500/- also imposed upon defendant No.01 to be deposited in District Court Dispensary till next, failing which any appropriate order shall be passed.
