Family Suit called. Plaintiffs called absent, but their counsel is present. The defendant was served through bailiff, service held good, but he is called absent. The memo of the plaint shows that the plaintiff No. 2 to 03 are neither children nor grandchildren of either party. The counsel submits that the plaintiffs No. 02 are 03 are children of the Plaintiff No. 1 from her earlier husband and the defendant No. 02 being brother of the plaintiff No. 1 entered into agreement that he shall bore all the expenses of the minors. It may be so, but this court cannot enforce the Agreement through which the defendants bound themselves for maintenance of the minor. when the counsel of the plaintiffs asked to argue on maintainability of suit, he sought to argue. At his request matter is adjourned to 23.10.2026 for hearing on maintainability of suit. |
