Matter called. The Advocate for Plaintiffs in Civil Suit No.183/2024 is present and filed application for consolidation of suits. Order passed on it. Notice to other side. Advocate for Defendant No.1, 3 & 4 in Civil Suit No.183/2024 are also present. None is present from Defendant No.2 & 5 side. Advocate for Plaintiff in Civil Suit No.856/2024 is present. Advocate for Defendant No.1 to 3, 5 & 6 are present. Advocate for Defendant No.1 in Civil Suit No.856/2024 filed an application under Order XVIII rule 18 CPC read with Section 151 CPC for appointment of commissioner. Order passed on it. Notice to other side. None is present from Defendant No.4 & 7 side. However, the parties in person are called absent. The Advocate for Plaintiffs in Civil Suit No.183/2024 has filed an application for consolidation of suits and contended that the subject matter and parties in both suits filed by them are identical. Therefore, he prays for the consolidation of both suits to avoid conflicting judgments and to ensure judicial economy. Upon which, Advocate for Plaintiff in Civil Suit No.856/2024 endorsed his no objection for consolidation of both suits. Order passed on separate order sheet. In view of the foregoing and to avoid conflicting judgments and further technicalities, ensure judicial economy, and streamline proceedings, both suits???Civil Suit No.183/2024 and Civil Suit No.856/2024 are hereby consolidated as both the suits have been filed by the same parties on same subject property. Consequently, joint issues shall be framed at the appropriate stage, if needed, based on existing pleadings.As far as the application under Order XVIII rule 18 CPC read with Section 151 CPC is concerned. In view of no objection endorsed by Advocate of leading suit is hereby allowed. The Nazir of this Court is appointed as Commissioner to inspect the suit properties bearing (1) Plot No.98/A, Sector 16-A, Sheet No.1, Shah Khalid Bin Abdul Aziz Colony, North Karachi Township, Karachi, ad-measuring 1546 square yards, claimed by Plaintiffs of leading Civil Suit No.183.2024 and (2) Plot No.R-486, Sector 16-A, Buffer Zone, North Karachi Township, Karachi, ad-measuring 120 square yards, claimed by Defendant No.1 of leading in Civil Suit No.183/2024, alongwith technical officials/staffs of departments viz. KDA, SKAA, SBCA & KMC with directions to inspect the above suit plots and submit their detail reports alongwith all relevant documents thereof so also proper demarcation etc. The Nazir/Commissioner fee is fixed at Rs.20,000/=. Plaintiff(s) of both suits are directed to deposit Rs.10,000/= each with the Nazir of this Court within 07 days. The matter is now adjourned to 15.10.2025 for compliance and reports. |
