Consequently, based on judicious assessment of material brought on record I am of firm view that prima facie a cognizable offence involving fracture (cognizable) and other injuries based on MLCs has been committed, which requires incorporation in terms of section 154 Cr.P.C followed by fair investigation in accordance with law, hence application in hand stands disposed of with direction to SHO concerned/In-charge duty officer to record his statement in terms of section 154 Cr.P.C in order to set law into motion and to ascertain real facts. |
