Today, the certified true copies of the Judgment dated 22-04-2026 and Decree dated 29-04-2026, passed in Civil Appeal No.38/2024 and Civil Appeal No.06/2025 by the Honourable Additional District Judge-II/MCAC, Mirpurkhas, have been received by this Court. Perusal reveals that both appeals were allowed by the Honourable Appellate Court, and the Judgment dated 31-01-2024 and Decree dated 07-02-2024 passed by this court in F.C. Suit No.75/2012, as well as the Judgment dated 23-11-2024 and Decree dated 29-11-2024 passed by this court in F.C. Suit No.76/2012, were set aside. The matter was remanded back to this Court by the Honourable Appellate Court with the direction to decide both suits afresh after proper evaluation of the pleadings, evidence, and material available on record, after providing full opportunity to all concerned parties to prove their respective cases. Thereafter, this Court shall pass proper, speaking, and reasoned Judgments in accordance with law. Virtue of the Judgment dated 22-04-2026 and Decree dated 29-04-2026 passed by the Honourable Appellate Court, the proceedings of the instant Execution Application have become infructuous. |
