Today matter was fixed for plaintiffs evidence. Learned counsel for the plaintiff filed affidavit-in-evidence along with an application seeking adjournment. The said application was opposed by the defense counsel. After hearing the counsel for the plaintiff and defendant, adjournment was granted so that matter may be decided on merits and last warning may be given to the plaintiff to produce evidence. As the undersigned granted the adjournment, learned counsel for the defendant began shouting at the undersigned, questioned the authority of the Court to grant adjournment, and levelled allegations of partiality and demand for transfer of the matter. His conduct was aggressive, contemptuous, and wholly unbecoming of an advocate. Learned counsel for the defendant is accordingly warned to remain careful in future and to maintain the decorum and dignity of the Court, failing which appropriate proceedings may be initiated. The conduct of the counsel is accordingly noted for information and appropriate action, if so required. However, It has also been observed that since many dates plaintiff is not recording his evidence despite warnings, therefore plaintiff is strictly directed to produce his evidence on the next heating, in case of failure the suit of the plaintiff will be dismissed in non prosecution and no further adjournment will be granted.
