Cr.M.A No.1746 of 2026 U/S 22-A(6)(i) Cr.PC fixed at Sr. No.16 of today???s cause list generated from CFMS-DC system is taken up in open Court. Applicant and her counsel are present. Mr. Aajiz Ali Arbani appeared and filed vakalatnama on behalf of proposed accused No.2 which is taken on record. DDPP is present. Heard. The record has been perused. According to the counsel for applicant, proposed accused have committed cognizable offence and whereas as per the counsel for proposed accused that no such incident took place and proposed accused on the relevant date and time were attending this Court in Cr.B.A No.1859 of 2026. After hearing and perusing the record, this Court is of the view that possibility of false implication of accused in the commission of alleged offence in the wake of matrimonial dispute cannot be ruled out. Therefore, instant Criminal Miscellaneous Application merits no consideration and it is hereby dismissed. However, the applicant shall be at liberty to avail an alternate remedy u/s 200 Cr.PC, if so advised. Such order is passed and pronounced in open Court and kept on separate sheet. |
