Matter called. Learned counsel for the plaintiff is present and submitted statement alonwith Courier receipt which are kept on record. None is present from defendants side. Process through Bailiff returned and Bailiff report is taken on record. Order passed on separate order sheet. Therefore, without touching the merits of the suit, the defendants are restrained from creating third party interest in the suit property. Moreover, the plaintiffs are claiming that they are possession of suit property, therefore, it is appropriate to appoint the Nazir of this Court to conduct the inspection in order to ascertain true factual position regarding the possession over the suit property. Hence, the Nazir of this court is appointed as Commissioner to conduct the inspection in presence of both parties and with the assistance of revenue officials and submit report regarding the possession over the suit property. Nazir fees is fixed at the rate of Rs.20000/- which shall be borne by the plaintiff. Let the copy of this order be served upon all the defendants through the Bailiff. Repeat summon on main suit upon the defendants No.7 to 9 through Bailiff on the pointation of plaintiff as well as pasting in presence of two witnesses and service upon defendant No.1 through Bailiff. The service is held good upon the defendants No.2 to 6. Put off to 12.11.2026 for service upon defendants No.1, 7 to 9 as well as filing W.S & C.A by defendants No.2 to 6 and also submission of court fee stamp. |
