The civil execution application is hereby allowed. The Plaintiff/DH is declared as lawful owner of suit property bearing No.R-749, Sector 15-A/1, Buffer Zone, North Karachi, Karachi. The Plaintiff/DH is entitled for recovery of Rs.24,500/= per month from Defendant/JD No.1 from the date of institution of instant suit i.e. 27.02.2023 in lieu of monthly rent collected by Defendant/JD No.1 from tenants of shops in suit property. The total amount of rent Rs.4,41,000/= [18-month X 24,500/=] shall be recoverable from Defendant/JD No.1 with annual markup of 15% from the date of this Judgment till payment to Plaintiff/DH. The Defendant/JD No.1 is directed to submit all original documents of suit property with the Nazir of this Court within 30 days from the date of this Judgment for handing over the same to Plaintiff/DH. The Nazir of this Court is directed to issue Notice upon Defendant/JD No.1 for submitting original title documents of suit property and after collecting the same, handed over to Plaintiff/DH after duly identification and verification. The Plaintiff/DH is directed to submit list of moveable and immoveable properties of Defendant/JD No.1 for recovery of amount of rent Rs.4,41,000/= [18-month X 24,500/=] shall be recoverable from Defendant/JD No.1 with annual markup of 15% from the date of this Judgment till payment to Plaintiff/DH. There is no order as to cost. Put off to 31.07.2025 for compliance. |
