Matter called. Advocate for Plaintiff is present. Advocate for Defendant No.1 is present. None is present from Defendant No.2 to 10 side. Matter is fixed for consideration of service upon the Defendant No.2, 3, 4, 5, 6, 7 & 8. Record shows that the summonses were issued to the Defendants through Bailiff, Registered Postal A/D and Courier service, but Defendant No.2 to 10 failed to appear. Record further shows that summons was duly affixed at the addresses of Defendant No.2, 3, 7 & 8 through Bailiff in presence of two witnesses and in this regard Bailiff statement was recorded at Exh-1. Finally, the summon was published in newspaper daily Express Karachi, dated 12.12.2024, but Defendant No.2, 3, 7 & 8 failed to appear. Record further shows that the summons was duly published upon Defendant No.4, 5 & 6 in daily newspaper The New International, Karachi, dated 10.01.2025, but Defendant No.4, 5 & 6 failed to appear. Copies of newspapers are kept on record. Advocate for Plaintiff contended that the Defendant No.2 to 10 are well aware about the present suit but they are deliberately avoiding to appear before this Court and also failed to file their written statements. In view of above facts and circumstances, service upon Defendant No.2, 3, 4, 5, 6, 7 & 8 is held good. Service upon Defendant No.9 was held good vide Order dated 11.03.2024 and service upon Defendant No.10 was held good vide Order dated 19.04.2024. Put off to 10.07.2025 for filling of written statements by Defendant No.2, 3, 4, 5, 6, 7, 8, 9 & 10 side. |
