That after framing of charge till yet prosecution has failed to examine a single witness, hence the proceeding of the case are stopped under section:249 crpc against the accused without pronouncing the judgment of acquittal or conviction. That Honourable High Court of Sindh in case reported as PLD 1990 Karachi 233 Re. Mst. SARDARAN BIBI versus THE STATE in para No.8 has Observed that ???The object of surety bonds is to ensure the presence of the accused persons. So, where the accused is released under section 249, Cr.P.C. and his presence is no more required by the Court, the surety is discharged???. Accused present on bail and in the light of above case law, the surety of accused on bail is hereby discharged, however accused is directed to submit P.R bond equivalent to his surety. |
