Received Criminal Miscellaneous application from the court of Honorable Sessions Judge Ghotki for disposal according to law. The applicant is absent. His counsel is present. ADPP for the State is present and waived the notice. Arguments heard. Order passed and announced. ?? Consequently, based on judicious assessment of material brought on record I am of firm view that injuries allegedly sustained by applicant???s son Muhammad Alim and 02 others per MLCs have been declared as a shajjah-i-khafifah, JGJ damiyah and other hurts which as per law are non cognizable, actual bone of contention between parties is purely of civil nature but applicant attempted to twist situation with malice to kneel down the proposed accused through criminal proceedings thus he did not come with clean hands and this is not a fit case for direction to SHO concerned to record applicant???s statement in terms of section 154 Cr.P.C, hence application stands dismissed being meritless. However, SHO concerned is directed to proceed in terms of section 155 Cr.P.C as regards the alleged non cognizable injuries. |
