Order passed and announced in open court , in the given situation and in the light of the above observations and the available record, I convert and treat this application as under Section 249 Cr.P.C instead of Section 249-A Cr.P.C. I, therefore, stop the proceedings of this case without pronouncing judgment either of acquittal or conviction. Consequently, the present accused Sarfaraz S/o Nazeer Ahmed Tunio are released on the same surety and the surety would remain intact for a period of three months while the other accused namely Zulfiqar S/o Mehrab Ali Sodhro & Shakeel S/o Nazeer Ahmed Tunio are already declared as Proclaimed offender. It is needless to mention here that the case will be re-opened when the complainant along with all the PWs will appear before this Court.
