Crl.Misc.application u/s 22-A,B, Cr.P.C called. Applicant/petitioner Ghulam Malik is present. Mr.Deedar Ali Bangwar, learned advocate of petitioner is present. Mr.Gahi Khan Bangwar, learned ADPP for the State is present. Proposed accused are called absent, notices issued against them return un-served by the process server ASI Noubat Ali as per his endorsement that they are absconders in Crime No.20/2025 of PS B/Section Kandhkot. For the reasons to be recorded, the instant application is found to be meritorious and is hereby allowed. The respondent No.1 (concerned SHO) is directed to record the statement of the applicant u/s 154, Cr.P.C, and if from such statement the commission of a cognizable offence is made out, the SHO shall proceed in accordance with law by registering the FIR. However, during the course of investigation, if the version of the petitioner is found to be false or fabricated, the concerned SHO shall be at liberty to initiate proceedings against him in accordance with the relevant provisions of law. Let copy of this order be sent to SHO concerned for information and necessary compliance. |
