Matter called. Learned counsel for the plaintiff is present. None is present from the defendants side. Process through Bailiff returned served upon the defendants No.1 and 2 and unserved upon defendant No.3. Repeat summon upon the defendant No.3 through Bailiff on the pointation of plaintiff as well as pasting in presence of two witnesses, Registered AD & Courier Service. The service is held good upon the defendants No.1 and 2. Order passed on separate order sheet. Therefore, the defendants are restrained from cancellation of the units of plaintiff and or allotting the said units to any third person till the next date of hearing. The plaintiff is directed to continue depositing the remaining installments (if any) in respect of suit property to the defendant No.1 and 2 and in case the defendant No.1 and 2 refused to receive the outstanding installments in respect of suit property, the plaintiff shall deposit the same forthwith to the Nazir of this Court. Put off to 11.11.2026 for service upon defendant No.3 and filing W.S & C.A by defendants No.1 and 2 as well as hearing on application U/O 39 Rule 1 & 2 CPC and also submission of court fee stamp as last and final chance. |
