Received application u/s 491 Cr.P.C from the court of Honourable Sessions Judge Ghotki for disposal according to law. The counsel for applicant and ADPP for the State are present. Order passed on separate sheet and announced. Present applicant, sought recovery of her daughter Shrimati Komal in terms of section 491 Cr.P.C with version that his son-in-law respondent Vinod Kumar did not allow him to meet his daughter which created apprehension in his mind that she will be confined so police authorities may be directed to recover her.Applicant and the learned counsel have been called absent despite several calls till 12-28 noon. It appears from application itself that applicant???s daughter is residing with her husband so no case of alleged wrongful confinement attracting section 491 Cr.P.C is prima facie made out and applicant did not come with clean hands. Consequently, Cr.M.A in hand stands dismissed for non prosecution with liberty to the applicant to address an application to police authorities or to seek civil remedy subject to law. |
