Order passed on separate sheet and announced in open court, From contents set forth in the application it appears that cheque No.69297920 worth of Rs.40, 00000/- dated 5.1.2026 Of Bank Al Falah Timergarha Lower Dir (KPK), issued by the proposed accused was returned/dishonored for insufficient balance by Al Falah Bank Shikarpur. It is settled principle of law that SHO of a Police Station is duty bound to record the statement of every person who appears before him and then lodge the FIR if cognizable offence is constituted from his version. SHO has got no powers to refuse from recording the statement u/s.154 Cr.P.C and registering the case if cognizable offence appears to have taken place. As the matter of fact, the application of applicant is supported with copy of cheque and Memorandum, as such the SHO PS New Foujdari is directed to record statement of applicant and incorporate its contents in 154 Cr.P.c book if cognizable offence appears to have been made out. The application stands allowed. He is further directed that in case of registration of the FIR the proposed accused shall not be arrested until and unless tangible evidence against him may come on record. During investigation, if it is found that the applicant has registered false case then action U/S 182 PPC be taken against him. In above terms, the application in hand stands disposed of. Parties are present and informed, accordingly. Let the copy of order be sent to SHO PS New Foujdari for information and compliance under intimation to this court within three days without fail. |
