Mr. Manish Kumar, Advocate, submitted that he had filed the application U/o 1 Rule 10 CPC on 02.07.2026, but the plaintiff has failed to file its counter. He prayed that the plaintiff may be debarred from filing the same so that the application may be fixed for hearing. Record shows that the copy of the application has been received by the plaintiff, almost four dates have passed, but the plaintiff has failed to file the counter. Moreover, vide order dated 18.07.2026, the plaintiff side was also put on notice to file the counter, but failed. Hence, the circumstances call for debarring the plaintiff from filing the counter affidavit to the Application U/o 1 Rule 10 CPC.
