Bail before arrest called. Applicant/accused namely Muhammad Younus son of Muhammad Ismail called absent. Learned ADPP for the state, learned counsel for the applicant/ accused & complainant in person are present. Counsel for the applicant/accused moved an application for condonation of absence of accused by alleging that the complainant, who is practicing advocate and his associate severally harassed the applicant/ accused, which creating a grave threat to his life, safety & physical well-being. On contrary; complainant denied the version and allegations of applicant/ accused. Although; learned counsel for the applicant/ accused request to grant time for production of applicant/ accused at about 11:30 AM but till 12:15 PM he remained absent. Today since morning above named applicant/ accused called absent, it is now 12:20 PM. The relief of bail before arrest is an extraordinary relief which cannot be granted / extended in absence of accused.?? The applicant/ accused was required to be present on time, but he remained absent, therefore, bail before arrest application in hand stands dismissed in non prosecution, therefore, interim bail granted to applicant/accused by the Honourable District & Sessions Judge, Karachi Central vide order dated 09.06.2026 stands recalled. |
