The instant summary suit is called. Mr. Asadullah Soomro, learned counsel representing the plaintiff, is present. The defendant is currently incarcerated at Central Prison, Karachi, facing accusations in a case registered at PS Kharader of Karachi for an offense punishable U/S 489-F PPC. The summons, in accordance with Form No. 4 of Appendix-B CPC, 1908, designated for summary suits, was served on him via the Superintendent of the prison. Hearing was scheduled for 24-07-2025 for seeking the leave to defend instant summary suit by the defendant; however, he failed to apply. Between that date and the last hearing on 03-11-2025, attempts were made to secure the defendant's presence via video link using Zoom or WhatsApp from the prison to verify whether the summons had been properly served or if the report of service from Superintendent of the prison was merely a formality. Unfortunately, these attempts were unsuccessful due to technical issues such as software outages or poor internet connectivity. Today, the defendant's presence was successfully obtained through a video link on Zoom with the co-operation of PC Shoaib and Tufail Mahar, focal/persons for video link production of accused/UTPs from Central Prison Karachi. The defendant acknowledged that the summons had indeed been served to him by Superintendent of the prison and requested additional time to file his application for leave to defend instant summary suit, either by submitting it through the Superintendent or through his advocate. His request was granted, and he was informed that next hearing for filing the application is scheduled for 16-12-2025. The matter is adjourned to 16-12-2025 for seeking leave to defend instant summary suit by the defendant.
