Rest of accused have already been declared as P.Os. The State counsel is present and counsel for complainant is absent. The counsel for accused is present. This case was pending on the file of the Court of Additional Sessions Judge-III Ghotki where charge against present accused was framed on 12.03.2025. Then what happened that on transfer of Presiding officer of the Court of Additional Sessions Judge-III Ghotki, reference was made by Honourable Sessions Judge, Ghotki to High Court of Sindh, Principle Seat at Karachi to transfer the cases to Court of Additional Sessions Judge-Ii Ghotki and Additional Sessions Judge Mirpur Mathelo, same reference was allowed/accepted and then case was assigned to this Court for disposal in accordance with law. Pertinent to mention here that FIR of the instant case was lodged for indicated offences w/w Sections 6/7 ATA. The Court of ATC Ghotki at Mirpur Mathelo took cognizance on FIR and challaned. Later on application was made by accused to transfer the case to Court of ordinary jurisdiction as sections of ATC are not attracting in the facts and circumstances of the matter. After that Court of ATC Ghotki at Mirpur Mathelo (Mr. Muhammad Yousif Gul Mangi) vide order dated 07.01.2025 transferred instant case from the file of his Court to the Court of ordinary jurisdiction/Sessions Judge Ghotki. The counsel for submitted that order dated 07.01.2025 passed by ATC Ghotki at Mirpur Mathelo has not been challenged before High Court of Sindh, Bench at Sukkur. This means either the complainant is satisfied of the order or otherwise passed by ATC Ghotki at Mirpur Mathelo. The counsel for complainant later on apprised the Court that complainant intends to challenge the said order. It is up to the complainant either to challenge the said order or otherwise. However this Court will pass or proceed the case strictly in accordance with law. The complainant is present and he is directed to bring his witnesses on next date of hearing. Accused are also directed to ensure appearance of their counsel on net date of hearing adjourned to 30.08.2025 for evidence or otherwise.
