Previously this criminal case was pending in the court of learned JM-XXIV Karachi West, where the charge was framed on 15.7.2025 thereafter the learned ADPP moved application under section 347 CrPC for reference the case as offense section 336 PPC is triable by court of session and the application was allowed by learned Mgistate vide order dated 13.10.2025 and the send R&P to the Honorable Session Judge Karachi West, where the case was transferred to this court. After framing charge no evidence recorded. After further record there are three accused in this case namely Muhammad Aziz Khan, Muhammad Khan and Muhammad Naseem Khan and out of them the attendance of accused Muhammad Naseem Khan and Muhammad Aziz Khan was exempted vide order dated 17.9.2025 on application under section 540-A CrPC. The Applicants/accused has also filed application under section 249-A Cr.P.C and same is pending for hearing.
