Therefore, in order to ascertain true factual position it is appropriate to appoint the Nazir of this Court as Commissioner to conduct the inspection in presence of both parties and submit report regarding the alleged construction. Nazir is directed to conduct such inspection by issuance of proper notices to the parties. Nazir fee is fixed at the rate of Rs.25000/- which shall be borne by the plaintiffs. Issue fresh contempt notices on the application U/O 39 Rule 2(3) CPC against the alleged contemnors whose names are mentioned in the application in hand through the SHO of concerned P.S.
