All accused are present on bail along with their counsel.ADPP is present.Complainant Mst.SHabeeran is present.Charge framed at exh:2,such pleas recorded at exh:2/A to 2/F.SIP Pir bux Bhutto is present and examined at exh:3 he produce relevant docuemnts at exh:3/A and 3/B.No ther pw is present.All accused filed application under section:249-A crpc.order on it.complainant filed no objection affidavit.same is kept on record.Heard.order passed and announced in open court. That Honourable High Court of Sindh in case reported as 2017 PCRLJ 219 (Sukkur bench) has observed that recording of prosecution evidence is not mandatopry condition while passing the acquittal order under section:249-A crpc and in absence of tangiable evidence further trial would be futile exercise. Hence, I am of the humble view that there is no probability of the applicants/accused namely Janib ali,Shahnawaz,Mashooque,Ahmed ali,Muhammad ali and Ghulam Hussain being convicted of any offence, therefore applicants/accused are hereby acquitted under section 249-A, Cr.P.C. Accused are present on bail their bail bond stands cancelled and surety discharged. |
