Case called. Accused(s) Sikandar, Akbar, Ali Asghar and Umar Bakeero are present on bail. Learned counsel for the complainant and learned ADPP for the State are present. On the contrary, Advocate Mr. Zakir Hussain Khaskheli is present representing the accused(s). Whereas it is the fact of the matter, adhering to the case record, that on 19th January 2026 another counsel moved a power/Vakalatnama on behalf of the accused, superseding the current Advocate. However, learned counsel has submitted that the said power filed on 19th January 2026 was merely filed by the accused on the pretext that he was occupied before some other forum, and that he is actually the counsel representing the accused(s). He has further urged that he may be granted an opportunity to file a new/fresh Vakalatnama on their behalf, which is considered, provided that a statement at the bar is filed that the counsel engaged on 19th January 2026 has no reservation regarding him representing the accused, along with the Vakalatnama, for the satisfaction of this Court that no professional fee is outstanding against the accused(s). On the other hand, learned counsel for the complainant has filed an intimation of the death of the complainant on 24.02.2026 along with her medical report. She is directed to produce the death certificate, which according to her would be received within the span of a week???s time, which is considered. Two private witnesses, namely the MLO and the IO, were in attendance, although the IO is presently absent without having sought prior permission of this Court. It is noted that a final show-cause has already been issued to the IO. It is thus adjourned to 13th April 2026 at 10:30 A.M sharp for recording of evidence of private witnesses and production of the death certificate of the complainant by the prosecution. Learned counsel for the accused is also directed to produce legal precedents on the point that this Court, being a Sessions Court, cannot impose costs on any party who remains absent from the court proceedings despite being provided with innumerable opportunities, on the next date of hearing i.e. 13th April 2026. 06-JAN-2026

Case called. Complainant and a private witness are present along with ADPP and counsel for her. On the other hand accused(s) is present yet again with an application for adjournment citing the reason that his counsel is out of station for some personal matter. The present application is dismissed on the context that charge was formally framed by the learned predecessor on 13.02.2024 and complainant/ victim was examined on 30th July 2024 since then it has been pending for recording of evidence of other witnesses but counsel for accused(s) has been playing with delaying tactic and making efforts to render proceeding in effected by prolonging it. It is further observed that an application was filed u/s 369 r/.w sect 540 CrPC in April 2024 which is what has been pending since past one had half year for presentation of his own argument which has not been rendered till date without any plausible explanation in spite of appearance of counsel for complainant and her witnesses. The application filed for adjournment is dismissed and learned ADPP is directed to get the examination of her witness recorded, however, accused(s) is directed to cross examine his witness on 19th January 2026, without any delay or failure, cross examined the witness either in person or the counsel and no further adjournment was granted to either side since the direction given from the Honourable High Court for expeditiously disposal in GBV cases.
