Record shows that after service of notice to defendants, the matter has been repeatedly fixed for supply of copy of plaint to defendant side, which has not been provided by the plaintiff side, who is called absent on 29-10-2024, 18-11-2024, 03-12-2024, 24-12-2024, 20-01-2025, 03-02-2025 and today again i.e. on 17-02-2025, plaintiff side is called absent on repeated calls and the matter is prolonging for supply of copy of plaint without any progress. 4. It stands candidly clear from the above discussed facts that plaintiff side has not been appearing before this Court since 29-10-2024 till date and has miserably failed to proceed the matter positively, which shows that either plaintiff has lost interest in proceeding of the case or intends to prolong the matter for indefinite period of time. It is settled law that law favors the vigilant and not indolent, hence adopting the said scheme of law, the suit of plaintiff is dismissed in default and non-compliance, with no order as to costs. |
