Matter called. Learned counsel for the plaintiff is present and submitted statement alongwith Courier and Registered AD receipts which are kept on record. None is present from the defendants side. Process through Bailiff returned and as per Bailiff report one lady came out from the house/address of defendants who refused to receive summon and also refused to disclose her name and relationship with the defendants. Repeat summon upon the defendants through Bailiff by way of pasting in presence of two witnesses. Order passed on separate order sheet. Therefore, the defendants are restrained from creating third party interest over the suit property till the next date of hearing. Plaintiff is directed to deposit remaining sale consideration amount of Rs.1,80,00,000/- within 30 days from today with the Nazir of this Court. Let the copy of this order be served upon all the defendants through Bailiff. Put off to 07.09.2026 for hearing on application U/O 39 Rule 1 & 2 CPC as well as service upon the defendants. |
