Received Criminal Miscellaneous application from the court of Honourable Sessions Judge Ghotki for disposal according to law. The applicant present along with counsel. The ADPP for the State is present. Arguments heard. Order passed on separate sheet and announced. Prayer by the learned counsel to the extent of fair investigation being legal and reasonable is hereby allowed with direction to SHO and I.O concerned to conduct fair investigation in order to un-earth truth that whether FIR in question is true or it is false or without sufficient evidence. However, prayer for direction to police authority to submit challan being beyond this court???s jurisdiction is declined because police authorities after fair investigation may decide to submit challan or to submit summary for disposal of FIR under ???B??? or ???C??? Class on basis of evidence to be collected during investigation which the learned Judicial Magistrate having jurisdiction is by law competent to peruse and to pass an order thereon in accordance with law. |
