Matter called. The learned counsel for the plaintiffs is present. Learned DDA on behalf of official defendants is present. Today the matter is fixed for service upon remaining defendants. Perusal of record/report of bailiff dated.20-10-2025 reveals that the notice was duly served upon defendant Nos. 04, 15 & 17. The report of bailiff dated.23-10-2025 reveals that the notice was duly served upon defendant Nos. 10, 11, 13, 14, 16, 18. Consequently, the official defendant No.16 (Mukhtiarkar (Revenue) Taluka Hala), through authorized clerk, got submitted his written statement on 17.11.2025 (Ex.11). As matter of record, Defendant No.10 (Faiz Muhammad) and defendant No.13 (Bashir Ahmed Abro) appeared and jointly submitted an application dated.29.11.2025 (Ex.12), and such report of bailiff dated.29-11-2025 (Ex.13) further suggests that the notice upon the defendants Nos. 02, 03, 06, 07, 08, 10, 11 was duly served. Thereafter, on 13-12-2025, the learned counsel for the plaintiffs submitted statement (Ex.15) annexing therewith TCS receipts showing that notice has been served upon the defendants Nos. 01, 02, 03, 04, 05, 06, 08, 09, 11, 12 & 19 through courier. In the event the official defendant No.18 (the Sub-Registrar, Hala), also got submitted written statement on 07.02.2026 (Ex.16). Record further reveals that on 07.03.2026, Mr. Abdul Wahab Memon, Advocate, filed Vakalatnama for the defendants No.1 to 8 (Ex.18), however, today, Mr. Imdad Ali Memon, learned Advocate, submitted undertaking/statement, stating therein that he will file Vakalatnama on behalf of defendants No.1 to 8, 11 and 12, on the next date of hearing, such undertaking/statement is taken on record at Exh-------------19. In view of the above, this Court is of the firm opinion that the summons of this Court has sufficiently been service upon all the defendants, although some of them have already appeared, and therefore, the service upon said defendants is treated as held good for the purpose of further proceedings.Put off to------------29.04.2026 for appearance and filing of written statements by the private defendants Nos. 01 to 13, as well as by official defendants No.14, 15, 17 and 19. |
