Execution Application is called. The Decree Holder is present along with his counsel. The Judgment Debtor is absent despite several calls. Notices against him through ordinary manner as well as publication issued. The service against him is hereby stands served.Arguments heard. Order passed and announced.Consequently what has been discussed, appreciated and reasoned above on the touch stone of law I am clear in my mind that no legal impediment exists to decline decree holders prayer hence I am inclined to allow Decree Holder???s execution application as prayed with no order as to costs with direction and another chance and opportunity to J.D named above to pay the decretal amount to the Decree Holder within a week with caution that in case of non-compliance strict legal action including his arrest, custody and remand to prison will be taken subject to law embodied U/S 51 CPC, 1907 read with Order XXI Rule 37 and other relevant sections and rules for satisfaction of decree because mere decree of suit and allow of execution application without its satisfaction is of no use and an Executing Court by law is bound to get a Decree satisfied within legal parameters within a reasonable time.
