Crl: Misc application u/s 145 Cr.P.C filed by Naseebullah S/o Abdullah Khan Pathan, R/O Dilawar Khan Bhatha, P.O Shadi Large through his counsel Mr. Bakar Khan Bhurgri against Muhammad Bux S/o Janoo, by caste Lund, R/o Deh Uth Daho, Taluka Kaloi. Heard and perused. Preliminary Order U/S 145 Cr.P.C passed, as per order 60,000 bricks of applicant are lying at spot and respondent No: 01 is stated to be illegally operating the Bhatta, selling the bricks, and to prevent breach of peace and irreparable loss, this Court deems it proper to invoke powers U/S 145(4) & 146(1) Cr.P.C, thereby SHO PS Kaloi and Mukhtiarkar Taluka Kaloi are directed shall forthwith proceed to the spot i.e. AL-AMAN Bricks Company, D.K-1, Mithi Road near Wango Stop, Deh Ath Daho, Tapo Kaloi and attach/seal the said Bhatta U/S 145(4) & 146(1) Cr.P.C. Both parties are directed to Cease/Stop all Bhatta operations forthwith. Neither party shall burn bricks, remove bricks (60,000 or more as alleged), or any other material as per inventory submitted by SHO, till final decision of instant application. SHO PS Kaloi shall prepare detailed inventory/Fard of ready bricks, kacha bricks, any other material lying at spot in presence of two respectable persons of locality and submit report within. SHO P.S Kaloi is directed to obtain/execute personal bonds in the sum of Rs.100,000/- (Rupees One Lac only) from respondent No: 01, as well from applicant for maintaining peace and public tranquility till final disposal of instant proceedings, with directions not to interfere, neither create any law and order situation nor continue work of Brick klin/Batha. In case of violation of above directions, the bond amount shall be liable to be forfeited/recovered from executants in accordance with law and further legal proceedings shall also be initiated against violators. Let notice be issued to respondent No.1 Muhammad Bux Lund to appear and file written objection regarding his claim of possession over disputed Bhatta. Copy of this order be sent to SSP Tharparkar, SHO PS Kaloi and Mukhtiarkar Kaloi for immediate strict compliance. Put up on 22-10-2026 for first compliance report of SHO Kaloi and Mukhtiarkar Kaloi, as well second detail report of SHO Kaloi and Mukhtiarkar Kaloi and appearance/written objection/statement of Respondent No.1. One copy shall be published by being affixed to some conspicuous place at or near the subject of dispute. |
