Crl.Misc.Appli.called.applicant sadam hussain and his counsel are called absent.Mst.Zareena khatoon is present and filed application duly supported by affidavit.order on it.DDPP is present.Recieved order passed in Crim.Rev.No.9/2023,Re:Mst.Zareena Versus Sadam Hussain and others, by court of Honourable II-Additional Sessions Judge Mirpur Mathelo,vide office letter no:265/2023 dated:20.3.2023,wherein it was mentioned that after correction with red ink in para no.1 and 13, transpires the city name of the Honourable Sessions Judge Shikarpur rather District Ghotki, which may be read as Honourable Sessions Judge Ghotki and dated:20.4.2022 instead of 22.10.2022.Heard and perused the material.order passed and announced in open court. Applicant Sadam Hussain and Mst.Zareena Khatoon are not entitled for restoration of 7 animals seized in Karawi No.4/2022 of PS M.mathelo,under section;550 crpc, however parties are at liberty to approach concerned court for their title, if so advised. As the order dated:20.4.2022 passed by this court, wherein custody of 7 animals was handed over to applicant sadam hussain was already set aside by court of Honourable II-Additional Sessions Judge Mirpur Mathelo vide order dated:10.3.2022,hence the copy of instant order be sent to SHO PS Mirpur Mathelo for information and compliance. |
