Perusal of the R&Ps sent up by the learned Civil Judge & J.M-II Matiari shows that cognizance of Section 324 PPC was taken and case R&Ps were sent up on the ground that offence punishable under section 324 PPC is exclusively triable by the Court of Sessions. Perusal of the police papers shows that in final medical certificate the injury is determined to be shujjah-i-khafiffah punishable under section 337-A(i) PPC, which is triable by the Court of Judicial Magistrate. The record further shows that ingredient of Section 324 PPC are not attracted to this case, therefore; the R&Ps of the above mentioned case is hereby transferred to learned Judicial Magistrate/presiding officer of Court of Consumer Protection to try and proceed with the matter in accordance with the law.
