Matter called. Learned counsel for the plaintiff is present. Learned counsel for the defendant No.1 and 2 is present and filed the counter affidavit to the application under Order XXXIX rules 1 and 2 CPC which is taken on record and copy supplied to other side. Mr. Asad Ali, Advocate filed undertaking to file vakalatnama on behalf of the defendant No.3 which is kept on record and received copies. Heard arguments on the application under Order XXXIX rules 1 and 2 CPC. Order pased on it. The defendant NO.1 is restrained from cancellation of the unit of plaintiff and or allotting the said unit to any third person till the next date of hearing. The plaintiff is directed to continue depositing the remaining installments (if any) in respect of suit property to the defendant No.1 and in case the defendant NO.1 refused to receive the outstanding installments in respect of suit property, the plaintiff shall deposit the same forthwith to the Nazir of this Court. Put off to 09.09.2026 for hearing on application U/O 39 Rule 1 & 2 CPC as well as filing W.S & C.A by the defendant NO.1 and 2 and service upon the defendant No.3 through Bailiff. |
