Waqas has filed application for condoning the absence of Mushtaque on the ground of his bad health condition. Order passed on the application ???condoned for today only???. Counsel for the accused persons Mr. Lutufullah Arain is present. The case is fixed for evidence of PWs. ADPP Mr. Mushtaque Ahmed Jamali is present. Complainant Mehboob Jokhio and other private PWs are present along with junior associate of their private counsel Mr. Ayaz Ali Gopang. The complainant intimates that if the counsel for accused is prepared to cross examine him and his witnesses, then Mr. Gopang can turn up in a while, as right now he is busy before some other Courts. On the other hand, Mr. Lutufullah Arain, counsel for the accused persons states that the charge of case is with his co-counsel Mr. Muhammad Wahab Arain, who, due to his personal affairs is unable to appear; therefore, a date may be granted to him. It has been observed that on each date of hearing, both parties have shown their reluctance on one or other pretext from proceeding with the case. It is worth mentioned that apart from the status of parties as complainant and accused, they are advocates by profession also, but their conduct has remained extremely disappointing. They are advised in their own interest to avoid lingering the case proceedings and appear along with their counsels to proceed with the case from stage of evidence of PWs on next date of hearing (06-01-2026) at 08:30AM. The parties did not agree on the date of their choice; therefore, the date has been by the Court which is a long date; considering the request of learned counsel for accused persons Mr. Lutufullah Arain that his co-counsel, who has charge of the case, is busy in preparation of examination of civil Judge and Judicial Magistrate, which is fixed in the end of this month.
