Criminal Misc: application U/S 22/A CR.P.C called. Applicant and his counsel are present. Proposed accused is present. Mr. Tahmasib Saeed advocate fled Vakalatnama on behalf of proposed accused. Order passed and announced in open court. The SHO PS Sanghar is hereby directed to record the statement of complainant, if from his statement cognizable offence is made out, his FIR be registered against above named proposed accused, and to act in accordance with law. SHO PS Sanghar is further directed not to arrest and no such unnecessary harassment shall be caused to the proposed accused named above, till sufficient evidence, concrete material becomes available on the record of investigation, prima facie satisfying the investigation officer regarding correctness of the allegations leveled against above named accused. If, FIR of the applicant, during investigation declared as false, then proceeding under section 182 PPC be initiated against the applicant. Application in hand stands allowed. Order accordingly |
