In the statement, the injured PW Arz Muhammad stated that he has entered in to compromise with accused persons without any duress or pressure and that compromise is voluntarily in nature. However, he claim the compensation of the injuries caused to him by he accused persons of this case. Heard. Order also passed, signed and announced in open court at Ext.21. For the reasons to be recorded. I am of the view that the applications under section 345-2 Cr.P.C seeking permission to compound the offence, merits consideration, therefore, the same is hereby allowed and in consequence thereof, the application U/S 345-6 Cr.P.C also stands allowed. Resultantly the accused namely Shahban alias Muhammad Shahban and Shahzado alias Zado, both by caste Jaffery, are hereby acquitted under section 345-6 Cr.P.C. Although the accused named above are acquitted under section 345-(6) Cr.P.C in consequence of compounding of this offence by the above named injured PW of this case but the Arsh and Daman amount of the injuries suffered by the injured PW namely Arz Muhammad has not been paid by the present accused to him. In this regard perusal of Medical Certificate of injured PW Arz Muhammad shows that he had suffered with the injuries punishable under section 337D and 337Fiii PPC. Therefore, the accused namely Shahzado alias Zado and Shahban alias Muhammad Shahban, are required to pay Daman amount Rs:50,000/- for causing?? injury punishable under section 337Fiii PPC to the injured PW Arz Muhammad. The accused namely Shahzado alias Zado and Shahban alias Muhammad Shahban, are further required to pay one-third of the diyat to the above named injured PW, for causing injuries No:2 and 3 (detailed in MLC of the injured) according to the current financial year. Resultantly, in spite of acquittal under section 345-(6) Cr.P.C the accused namely Shahzado alias Zado and Shahban alias Muhammad Shahban, are required to pay the above mentioned compensation amount to the above named injured PW. In order to execute instant order the accused namely Muhammad Shahban alias Shahban, who is present before this court on bail is taken into custody for want of payment of above mentioned compensation amount to the above mentioned injured PW. However, his bail bond stand cancelled and surety is discharged. ??Furthermore, in order to execute instant order the accused namely Shahzado alias Zado, who is confined in Central Prison and Correctional Facility Sukkur, shall remain behind the bars till he makes the payment of above mentioned compensation amount good, to the above named injured PW.??Let compromise application u/s 345-2 Cr.P.C be sent to accused Shahzado @ Zad, through Supt.C.P-I Sukkur for obtaining consent/LTI/signature on it with directions to sent back the same to this office for court record. | For Evidence | 0 | 0 | ADJ I, Kandhkot |
