Suit called Mr. Imran Zaib Rajput, Learned Counsel for the Plaintiffs is present and heard on the point of maintainability. Order passed on separate sheet at Ex-------03. In view of the express bar contained in Section 91(2)(iii) of the Act, read with Section 9 C.P.C., and keeping in view the settled dictums of Superior Courts regarding the exclusivity of special tribunals, this Court lacks jurisdiction and therefore, the plaint of the present suit is hereby rejected under Order VII Rule 11 (d) C.P.C as being barred by law, with no order as to costs.The suit at hands stands disposed of accordingly along with all pending interlocutory application(s), if any. Office is directed to consign the R&Ps into the Record Room for safe custody after completing necessary formalities. |
