R & P of instant case received to this Court by the order???s of Honourable District & Sessions Judge Karachi Central. From perusal of diary sheet it appears that since long accused person remained absent and warrants were issued and since then instant matter one or the other reason adjourned for same purpose, if the same practice is continued then no fruitful result will be served, hence his bail stands cancelled and surety forfeited.\ As per case law reported in 1987 MLD 1032 Karachi whereby the Honourable Apex Court held that if NBW was issued against accused, then his bail was automatically be cancelled and it is not necessary to issue notice to surety and accused.?? It is, therefore, hereby ordered to keep this case on dormant file and to be reopened as and when accused person (s) is/are arrested or appeared before the Court. Issue perpetual warrant against accused and CNIC???s of accused and his surety ordered to be block till further order. SSP is directed to trace and block the CNIC and SIM cards of above named accused person(s) and his surety. Office is directed to issue letter to SSP accordingly. |
