Per file in hand charge in this case was framed on 19.09.2023 and only tapedar (Ex-10) was examined on 05.03.2024 and thereafter, the learned defence counsel Mr. Muhammad Sharif Misrani for accused Abdul Ghaffar and learned counsel Mr. Zafar Hayat for rest of the accused did not proceed this case despite Court directions, with last even final chance which caused return of PWs un-examined from time to time and Mr. Muhammad Sharif Misrani being President of DBA, Sanghar also several times warned this Court to face adverse consequences by using bar influence if his cases are proceeded as per law. Today is also the same position. Complainant along with two private PWs and his counsel are present and submit that this case may be proceeded and decided as per law because FIR pertains to year 2022 and this case pertains to year 2023, but the learned counsel Mr. Muhammad Sharif Misrani and Mr. Zafar Hayat have been called absent without intimation despite several calls since morning. The Honourable High Court of Sindh Karachi as well as Honourable, District & Sessions Judge, Sanghar time and again in writing ordered for fixation of such cases twice a week and expeditious disposal as per law but most of the learned counsel of DBA Sanghar do not proceed cases regularly, case file is full of adjournment applications and whenever cases are proceeded as per law and as per guide line laid down under National Judicial Policy they become aggressive and start using criminal force, insulting attitude in open Court and false propaganda against Presiding Officer of this Court. As usual learned defence counsel sent adjournment application through Pupil advocate Mr. Pir Bux Shar Baloch. Order passed thereon.
