Case called. Accused Zakir Hussain is produced in custody from sub jail Shahdadkot. Learned ADPP for the state is present. Charge was framed against accused as (Exh. No.2), in which the accused pleaded not guilty and claimed for trial, such Pleas was recorded as (Exh. No. No.2/A. In order to prove the charge prosecution examined complainant PW-1 Roshan Ali at (Exh.No.3), he produced FIR as and application for withdrawal of witness at (Exh. No. 3/A to 3/B) respectively. PW-02 Nizam was examined at EX 04 . Thereafter learned ADPP for the state closed the side of prosecution with statement at (Exh. No.5). As the prosecution brought nothing on record against the accused persons, so therefore no need record the statement of accused as enshrine u/s 342 Cr. P.C. Heard arguments. Judgment passed and announced in open Court. Accused Zakir Hussain is acquitted u/s 245-I CR.P.C. The accused is produced in custody is sent back to custody with directions to release him forthwith if he is no more required in any other custody case crime. |
