Perusal of the R & Ps sent up by the learned Civil Judge & J.M-I Matiari shows after taking cognizance of offence punishable Section 324 PPC, he sent up the R&Ps of the case for the reason that same is exclusively triable by the Court of Sessions. Perusal of the police papers shows that in final medical certificates the injuries of injured Javed, Sohail is determined to be Shajjah-i-Mudihah, JGJ Badiaah and lacerated JGJ Mutalahimah and the injuries are as shown in the medicolegal certificates are punishable under section 337-A(i),AF(ii), F(iii) which are triable by the Court of Judicial Magistrate. The record further shows that ingredients of Section 324 PPC are not attracted to this case.
