Suit called. Advocate for the plaintiff is present. Notices were issued and as per bailiff report notices are served upon Mukhtiarkar Gulshane-e-Iqbal and Deputy Commissioner East. Miss Suraiya Khanzada, learned DDA submitted memo on behalf of defendant No. 1 to 4 . Mr. Pir Faraz Ahmed Advocate has submitted his memo on behalf of defendant No. 5, SBCA. Learned DDA and learned counsel for the defendant No. 5 have received the copy of plaint and Application U/O XXXIX Rule 1 & 2 CPC. Service upon the defendant No. 1 to 5 is held good. Heard counsels for the parties. Order passed on Separate sheet. The operation of the letter dated 19.09.2025 cannot be suspended, but as far as the apprehension of the plaintiff that his building will be demolished is concerned same is also not worthless therefore till next date of hearing, the defendants are restrained from demolishing the building of the plaintiff, if same does not fall within NA Class No. 210. Application U/O XVIII Rule 18 CPC for site inspection is also allowed and Nazir of this Judicial District is appointed as Commissioner for visiting the suit land, he can seek technical assistance from Mukhtiarkar or any other relevant authority, and submitting his report regarding possession of the parties. The Nazir Fee is fixed as Rs. 20,000/- which will be paid by the plaintiff directly to the Nazir. Nazir is directed to submit his report on next date of hearing. Put up to 13.01.2026 for repeat service upon defendant No. 6 and for filing of W/S and C/A by defendant No. 1 to 5. |
