Today the instant suit is fixed for compliance with the order dated 10.04.2026 and for hearing of objections to the applications filed under Order XIII Rules 1 & 2 CPC and Order XVI Rules 1 & 2 CPC. Learned counsel for defendants Nos. 4 to 6 has raised no objection. A detailed order has been passed on a separate sheet, whereby both the applications filed under Order XIII Rules 1 & 2 CPC and Order XVI Rules 1 & 2 CPC have been allowed, subject to payment of costs amounting to Rs. 2,000/- by the plaintiff to the Taluka Bar Association, Shahdadpur. The Assistant Commissioner, Shahdadpur, has submitted a letter bearing No. AC/SHD/835 of 2026, dated 16.10.2026, stating that police protection is required to prevent any untoward incident. It has been reported that, on previous occasions, the occupants/defendants misbehaved with and threatened the revenue staff and obstructed them from carrying out the demarcation of the suit property. The Staff from the office of Assistant Commissioner has further stated that the same situation was encountered by him, as the defendants did not allow the revenue officials to enter the suit property for inspection and to carry out the directions of this Honourable Court. On the contrary, learned Naseer Ahmed Rajput counsel for private defendants denied the allegation and submitted that the current application is moved by their party and they will extend cooperation. Such order passed on order sheet. The parties present are directed to extend full cooperation to the revenue officials during the demarcation proceedings. The SHO, Police Station Shahdadpur, is directed to provide necessary police assistance to the revenue officials to ensure the peaceful and unhindered demarcation of the suit property in accordance with the directions of this Court vide order dated 10.04.2026.
