The State counsel and counsel for accused are present. Complainant and P.W Malik Dino are present. Notice to accused under section 495 Cr.P.C for his cancellation of bail under section 497(5) Cr.PC has been received as to why bail granted to accused by this Court vide order dated 08.01.2025 may not be cancelled and bail bonds be forfeited as bail has been granted to accused not on merits rather bail on affidavits sworn by the complainant, parents and widow of deceased. Issuance of notice to accused is for the purpose that the legal heirs of deceased are not appearing before the Court despite notice and clear direction to make their appearance which may give presumption of tempering of evidence by accused and amounts to misuse of his bail. Even otherwise, bail has been granted to accused on affidavits, when section 302 PPC has been applied and same is compoundable, while as per State counsel the Section 396 PPC is applicable in the facts and circumstances of the case and same is non compoundable. If the legal heirs of deceased who have already sworn affidavits of accused, then they would have surely made appearance before the Court. The counsel for accused at this stage apprised the Court that he is going to withdraw from the vakalatnama of accused as on each date the Court is passing such remarks. The Court notices that the accused has engaged his counsel rather than counsel has been engaged by the Court and whatever the Court remarked that is in accordance with law that bail has not been granted to accused on merits and in non compoundable offence so at earliest he should proceed with the case. The summons to remaining official P.Ws is being returned unexecuted by process server P.C Jamaluddin; henceforth his report be made to SSP Ghotki for necessary disciplinary action in accordance with law including his removal from the process cell being his unsatisfactory performance or any other order as deemed fit and proper under intimation to this Court on the next date of hearing.
