Matter is called, Accused Waqas is present on bail, his counsel is present. DDPP for state is present. The two matters were called today but no prosecution witnesses are present. The record reflects that Court process has been conclusively issued and directives have been made to SHO Madina Colony for executing BWs and NBWs but he has failed to execute the same. The charge in the matter in hand was framed on 2.10.2025 and it has been more than five months since when no prosecution witness has appeared in the witness box. The counsel for the applicant/accused has already moved application under section 265-K CrPC, which is pending for disposal since 2.10.2025. The conduct of the prosecution witnesses who are police officials except complainant reflects that they were more interested to keep the accused behind the bars without any trial. They are using the shoulders of the Courts to fulfill their ulterior designs and when it comes to deliver justice, they remain away from the Court. The Court cannot act as a silent spectator and let the law be encroached by the police being State organ. In this regard DIGP West Zone is directed to initiate the departmental action against all those police officials who have avoided their appearance including SHO Madina Colony. The DIGP shall further ensure that all the PWs in the matters in hand, police papers and case property is to be produced before this Court on next date of hearing. Office is directed to send NBWs against all the PWs through DIGP West Zone Karachi. As to the application under section 265-K Cr.P.C. is concerned, the same shall be heard and disposed of in case the prosecution fails to examine its witnesses on the next date of hearing.
